弱さを強さに変えることは強みである Turning Weakness Into Strength Is Itself a Strength

 弁護士の仕事には責任が重いものもあれば軽くないものもあり、要するにだいたい全部重いんですけど、負荷がかかる事件が一度にまとめて降ってくることがあります。それでつぶれるとまずいので普段からなるべく余力を残していますが、それでも重たい事件が一度にまとめて降ってくることはあり、覚悟しないといけないのがこの仕事の性だと私は考えています。

Some of the responsibilities in a lawyer's work are heavy, and some are not exactly light either — in short, pretty much all of them are heavy. Every so often, several demanding cases land on my desk all at once. Being crushed by that would be a real problem, so I normally try to keep some reserve capacity. Even so, heavy cases do sometimes pile up together, and I've come to think that being prepared for that is simply the nature of this profession.

 他方でお客さんにしてみれば弁護士が忙しいかどうかは知ったこっちゃないので、仕事を頼まれたからにはやるべきことをきちんとやらないといけないのですが、いかんせん多忙であることは細かなミスを誘発します。

On the other hand, clients understandably don't care whether their lawyer is busy or not. Once I've taken on a matter, I have to properly do what needs to be done — but being overwhelmed with work inevitably invites small mistakes.

 細かなミスでクライアントの信頼を失ってしまっただろうかと心配になることもあり、多忙であることとどう付き合うかは自分自身の課題だと感じています。

There are times I worry whether a small mistake has cost me a client's trust, and how to manage being busy is something I feel is very much my own ongoing challenge.

 

 とか思っていたところ、たまたま読んだとある法律事務所の先生のインタビュー記事がとても良かったので勝手に紹介します(面識はないけどたまたま同期の先生でした。)。

While I was thinking about all this, I happened to read an interview with a lawyer at another firm that I found genuinely moving, so let me share it here on my own initiative (I've never met him, but it turns out he's from the same bar admission class as me).

 

 勝手に要約すると味気ないですが、重いタスクがどんどん積み重なって精神的にきつくなって、短期間だけ音信不通になったけど、でも立ち直ってクライアントの信頼を回復したというお話です。

Summarizing it in my own words strips away some of its nuance, but in short: heavy tasks kept piling up, it became mentally overwhelming, and for a short time he became unreachable — but he managed to recover and rebuild his clients' trust.

 

 人は誰しも弱さを抱えていますが、その弱さと正面から向き合えれば強さになり、その姿勢に人は信頼を寄せるという大事なことを教えていただきました。

Everyone carries some kind of weakness, but being able to face that weakness head-on is itself a form of strength — and it's that attitude that earns people's trust. That's an important lesson this article taught me.

退去強制令書発付処分等の取消し Revocation of the issuance of the deportation order

 私が原告訴訟代理人を務めた事件で、東京地方裁判所は退去強制令書発付処分等を取り消すことを内容とする判決を2026年5月13日に言い渡しました。

 同判決は国の控訴なく確定し、その後、東京出入国在留管理局は依頼者に対して在留を特別に許可しました。

In a case where I served as the legal counsel for the plaintiff, the Tokyo District Court rendered a judgment on May 13, 2026, revoking the disposition of the issuance of the deportation order and related administrative dispositions.

The judgment became final and binding without an appeal by the government. Subsequently, the Tokyo Regional Immigration Services Bureau granted special permission to stay to my client.

開催しました「街弁のための英語講座」 Post-Event Report: English Seminar for Lawyers

 表題のゼミで講師を務めました。ゼミの目的は2つ。

 ①英語が話せる弁護士の養成②弁護士と通訳人のコミュニケーション 

I served as the lecturer for the seminar titled above. The seminar had two primary objectives: (1) training attorneys to be proficient in English, and (2) facilitating effective communication between attorneys and interpreters.

 この業界は真面目な人が多いので、アメリカのロースクールを卒業していないと英語で仕事はしちゃいけないんじゃないかとか、帰国子女ではないから英語で仕事ができないとかそういう声を聞くことが多いです。でもあなたは高野隆先生じゃないけど刑事弁護やってますよね?

Since many individuals in this profession are quite serious-minded, I often hear concerns that one should not handle legal matters in English without having graduated from a U.S. law school, or that working in English is impossible if one is not a returnee. However, while you are not like Mr. Takashi Takano, you are handling criminal defense, are you not?

 弁護士としての善管注意義務が果たせることが必要条件であって、留学してたとか帰国子女であるとかは十分条件だと私は考えています。もっとも、教材が不足しています。弁護士会の研修サイトを見ても、法律図書のサブスクを見ても、すぐに使えそうな教材は見つかりませんでした。

I believe that the necessary condition is the ability to fulfill the duty of care as a lawyer; having studied abroad or being a returnee is merely a sufficient condition. That said, there is a lack of educational materials. Even after reviewing the bar association's training website and legal publication subscriptions, I could not find materials that were ready for immediate practical use.

 なので勝手に作っちゃいました。例えばこんな感じです。

So, I decided to take the lead and create some materials myself. Here is a quick look at what I have put together.

 

 もちろん外国にルーツがある人が全員英語を話すわけではありませんが、少なくとも英語を使って司法アクセスができる状況は日本のどの地域でも確保されないといけないと考えています。

Of course, not every person with international roots speaks English, but I believe we must ensure that access to justice via the English language is guaranteed in every region of Japan.

②通訳人とのコミュニケーション facilitating effective communication between attorneys and interpreters.

 弁護士から通訳人に理解して欲しいこととしては、要件事実との関係で聴き取りたい事実があるから正確に訳して欲しいとか、弁護士倫理との関係で聴き取らないとまずいのでしつこく聞いているとか、そういった弁護士側の事情が共通理解としてあるとより良い仕事ができると考えています。

Regarding the collaboration between attorneys and interpreters, I believe we can achieve better results if there is a shared understanding of the attorney's perspective. For instance, attorneys need precise translations because certain facts must be elicited in relation to the "Yoken-Jijitsu", or they may probe persistently because failing to do so could result in a breach of professional legal ethics.

 通訳人から弁護士に理解して欲しいこととしては、私が同業者に頼まれて警察署で英語の通訳をすることもありますが、文学的な表現とか幅のある表現とかは曖昧になりがちなのでなるべく避けて欲しいとか思うこともあります。私は「起訴状の書き方みたいな話し方」が良いと考えています。

From the interpreter's perspective—and I say this as someone who occasionally provides English interpretation at police stations upon request from colleagues—it is helpful when attorneys avoid literary or broad expressions that tend to be ambiguous. I personally believe that speaking in a style similar to how an indictment is drafted is ideal.

 今回のゼミには数名の通訳人の方がご参加くださり、意見交換もできたので良いきっかけになったと考えています。

I am pleased that several interpreters participated in this seminar, providing a valuable opportunity for us to exchange views.

休職 Leave of Absence

 私の依頼者は外国ルーツの方が多く、ご相談の内容は労働事件が多いです。そのうち一番多いのは解雇されたとか退職勧奨されたとかですが、その次に多いのは休職です。 メンタルヘルスに懸念がある方から、いま会社を休んでいるんだけどいつまで休めるのかとか、このまま良くならなかったら解雇されるのかとか、そういったご質問を頂戴することが多いです。

Many of my clients have international backgrounds, and a significant portion of the consultations I receive pertain to labor disputes. Among these, the most frequent cases involve dismissals or invitations to mutual separation; however, the next most common issue relates to leave of absence. I often receive inquiries from individuals with mental health concerns, such as how long they are permitted to remain on leave or whether they will be subject to dismissal if their condition does not improve.

会社の義務 Obligations of the Company 

 会社は労働者に対して、仕事をさせるにあたり、労働者が心身の健康を損なうことがないよう注意したりする義務や、必要に応じて業務を軽減するなどして配慮する義務があります(最高裁判決平成12年3月24日、最高裁判決平成26年3月24日等)。

 体調が優れない従業員がいる場合、無理に働かせることは上記の義務に違反するので、会社としては、より負担の少ない方法を探すことになります。まずは残業の禁止、働く時間の短縮、出社停止などを検討することになります。

When assigning work to an employee, a company has an obligation to take care to ensure that the employee does not suffer any physical or mental harm, as well as an obligation to exercise due consideration by reducing the employee's workload as necessary (Supreme Court Judgments of March 24, 2000, and March 24, 2014).

If an employee is in poor health, forcing them to work would constitute a breach of the aforementioned obligations. Therefore, the company must seek methods that impose less of a burden on the employee. As a primary step, the company should consider measures such as prohibiting overtime, shortening working hours, or suspending the requirement to report to the office.

休職 Leave of Absence

 それでも体調が優れず、例えば、欠勤が何日以上になると見込まれる場合とか、医師が休んだ方が良いと診断した場合とか、体調不良により業務に支障を生じる場合とかに、会社は労働者に休職命令をすることが一般的です。

 いわゆる体調を崩した場合の休職について法律上の定めはないので、会社は就業規則に盛り込んだり休職規程を作ることになり、労働者はそれに従うことになります。

 なお、会社に休職制度が設けられている場合、これを経ずにいきなり解雇すると解雇権濫用と評価され得るため、休職なしでいきなり解雇は考えにくいです。

 休職の定義は、「ある従業員について労務に従事させることが不能または不適当な事由が生じた場合に、使用者がその従業員に対し労働契約関係そのものは維持させながら労務への従事を免除することまたは禁止すること」が一般的だと思われます。

It is common practice for a company to issue an order for a leave of absence to an employee in situations where, for example, it is anticipated that absences will exceed a certain number of days, a physician diagnoses that the employee should take time off, or the poor health condition impairs the performance of business operations.

As there are no statutory provisions regarding a leave of absence due to health issues, companies typically incorporate such terms into their work rules or establish specific leave of absence regulations, with which employees are required to comply.

Furthermore, if a company has established a leave of absence system, terminating an employee abruptly without first utilizing this system could be deemed an abuse of the right to dismiss; therefore, it is unlikely for a dismissal to occur immediately without a prior leave of absence.

A leave of absence is generally defined as "the employer's act of exempting or prohibiting an employee from engaging in labor while maintaining the employment contract itself, in the event that circumstances arise rendering it impossible or inappropriate for said employee to perform their duties."

休職中に解雇されないか Can an Employee Be Dismissed During a Leave of Absence?

 労働者が抱えている傷病の原因が業務に起因する場合、会社は、療養中の労働者を解雇できません(労働基準法19条1項)。業務起因性があるかないかの判断は難しく、労災認定されなかったけど裁判所が業務起因性を認めて解雇を無効と判断した事例もあります(東芝事件(最高裁判決平成26年3月24日 ))。後に解雇無効と裁判所に判断に判断されるリスクを避ける場合、会社は解雇しません。

If the cause of an employee's injury or illness is work-related, the company is prohibited from dismissing the employee while they are undergoing medical treatment (Article 19, Paragraph 1 of the Labor Standards Act). Determining whether a condition is work-related can be complex; there have been cases where, despite the condition not being certified as a labor accident by administrative authorities, the court recognized the work-relatedness and ruled the dismissal invalid (e.g., the Toshiba Case, Supreme Court Judgment of March 24, 2014). To avoid the risk of a court subsequently determining a dismissal to be invalid, companies generally refrain from terminating employees under such circumstances.

復職か退職か Reinstatement or Termination

 休職は解雇の猶予と位置付けられています。労務を提供できないという事情がなくなれば復職することになりますし、事情が残る場合には退職することになります。 一つの基準は、休職期間満了時までに、「従前の職務を通常の程度に行える健康状態に復した」かどうかです。(浦和地方裁判所判決昭和40年12月16日)。

 では、そこまで回復しているかはっきりしない場合にはどうなるのかというご相談が多いのですが、通常の業務に戻れる見込みがある場合には復職を拒否しちゃダメ、と実務上は判断されていることが多いと思われます(エールフランス事件(東京地裁判決昭和59年1月27日)参照)。

 では、そこまで回復していない場合にはどうなるかというご相談も多いのですが、職種・業務が限定されていない方については、会社は、当該労働者について他の職種・業務への配置を検討することが一般的だと思われます(最高裁判決平成10年4月9日)。

 他方、職種・業務が限定されている方については、従前の業務をそれまでどおりに行える状態に回復していなければ、基本的には復職は認められないことになりますが、職種・業務変更が会社内で一般的に行われていたり、就業規則で職種・業務の変更が予定されていたりするような場合は、他の職種・業務への配置を検討すべきという話になります。

A leave of absence is positioned as a stay of dismissal. If the circumstances preventing the provision of labor are resolved, the employee shall be reinstated; if such circumstances persist, the employment shall be terminated. One established criterion is whether the employee has "recovered to a state of health that allows them to perform their previous duties to an ordinary extent" by the time the leave of absence period expires (Urawa District Court Judgment of December 16, 1965).

I frequently receive inquiries regarding cases where it is unclear if the employee has recovered to that extent. In practice, it is often determined that reinstatement cannot be refused if there is a reasonable prospect that the employee will be able to return to their ordinary duties (refer to the Air France Case, Tokyo District Court Judgment of January 27, 1984).

Furthermore, I often receive questions regarding what happens if the employee has not recovered to that extent. For employees whose job categories or duties are not restricted, it is generally expected that the company considers reassignment to other job categories or duties (Supreme Court Judgment of April 9, 1998).

On the other hand, for employees whose job categories or duties are restricted, reinstatement will basically not be permitted unless they have recovered to a state where they can perform their previous duties as they did before. However, if changes in job categories or duties are commonly practiced within the company, or if the work rules contemplate such changes, the company would be required to consider reassignment to other job categories or duties.

4月1日からの所属がなかった話 「4月1日から居場所を失ってしまう方へ」(工藤啓さんの記事の紹介)

毎年同じ記事を投稿することにしました。昨年の4月に投稿した内容と同じです。

 

今年も4月を迎えました。桜が咲いてようやく春が来ました。花粉はちょっとしんどいですけど、暖かくて過ごしやすい季節です。

 

が、私は4月がとても苦手でした。私には4月1日に所属がなかった時期がありました。

 

私はロースクールに入るまで受験勉強をしたことがなかったので(大学は推薦入試でした。)、ロースクール入試に大変苦戦していました。結局、大学を卒業してからロースクールに入るまでに5年ぐらいかかりました。ロースクールには

・3年間の未修者コース(法学部出身者ではない人向け)

・2年間の既修者コース(法学部出身者向け)

2つのコースがあって、

・未修者コースはすぐに入学できるけど司法試験の合格率は低い

・既修者コースは法律科目の試験が難しいけど司法試験の合格率は高い

という違いがあります。

 

私は未修者コースに入学して3年勉強して司法試験に合格する自信がなかったので、独学で法律の勉強をして既修者コースに入ることを目指していました。お金がなかったので独学でしたが、将来の自分に投資して予備校に通っていればもっと早くロースクールに入れただろうと今となっては思います。

そんなわけで独学で5年くらい勉強をしていたので、所属先のない状態で4月1日を迎えたことが何回かあります。


4月を迎える度に、というか実際にはその前の3月とか2月くらいですが、人と話すと、4月からどこに進学しますとか、4月からどこに就職しますとかそういう話になります。私はどこにも所属できていないので、自分が先に進めていないことを自覚せざるを得ない時期でした。友達の4月からの進路を聞いても素直に喜べなかったです。

 

というか、もう少し正確に申し上げると、素直に喜ぶ気持ちは全然湧いてきませんでした。自分のことで精一杯なのに、人のことを喜ぶ気持ちにはなれませんでした。でもそんな気持ちで過ごしていると友達がいなくなってしまうので、喜ぶ気持ちを必死に絞り出していました。

 

そんな経験があったので、お会いしたことはないですけど、認定特定非営利活動法人育て上げネットの工藤さんの「4月1日から居場所を失ってしまう方へ」という記事が毎年3月末頃にインターネットに掲載されることをいつぞやからか知るようになりました。

今年もお見かけしたので、多くの方にご覧いただきたいと思い、紹介させていただきます。毎年勝手に紹介する予定です。

【同業者向け】若手弁護士向けゼミ 2025年4月24日午後6時~ 街弁のための英語講座&通訳を介した会話の技法

表題のゼミを開催します。法律相談、委任契約締結時、受任中、終結までの間に依頼者との間で交わす英語についてお話しする予定です。英語話者の方の(もちろん英語に限りませんが)司法アクセスが実現・充実することを願っています。

 

法律相談/Legal Consultation/Asesoría Legal

法律相談の場では単に法的な見解を述べればそれで足りるわけではない。相談者さんが何かに怒っているとか、不安でたまらないとか、感情が揺れ動くことは人間なので当然あるわけで、そういう時は単に法律を適用して解決できるわけではない。

法的なことに限らず、身の回りで過去に起きた様々なこと、これから起こりそうなこと、家族構成、ご相談者さんの立場やご要望、関係者のご要望まで全て教えていただいて、これからどうしていくのが良いかを一緒に考えることになる。

初めて会う方と30分やそこらで考えて結論を出さないといけないのでそれなりに大変な作業ではある。暗闇を手探りで進むような感じになることもある。

だけども私は法律相談にやりがいを感じる。なぜなら法的には必ず何かしらの結論が出るからであり、進むべき光が見えるからである。もちろん光に手が届くかどうかはわからない。それは法律相談の次の段階の話である。

私がどこで何をしているかはあまり詳しくは説明しないが、紹介ではない方で、かつ、外国ルーツの方の法律相談を突然受ける機会は他の弁護士と比べてかなり多い方だと思う。

弁護士の本来のフィールドは裁判所であり、本来のメインの仕事は裁判で闘うことである。だけども、この仕事をしていると、法律相談には相談者さんの人生を変えられる力があると確信する場面はたびたび訪れる。

1月は、司法へのアクセスが実現するにはどうすればいいかいろいろ考えることが多い月だった。来月以降はいろいろ考えた計画を実行したい。

 

In a legal consultation, simply providing a legal opinion is not enough. It is quite natural for clients to feel angry, overwhelmed by anxiety, or emotionally unsettled. In such moments, the issue cannot be resolved by merely applying the law.

I need to hear everything—not just the legal facts, but various past events, potential future developments, family structure, the client’s perspective and desires, and even the wishes of other parties involved. Together, we figure out the best way forward.

It is a demanding task, as I must think through the situation and reach a conclusion in just 30 minutes or so with someone I’ve never met before. At times, it feels like fumbling through the dark.

However, I find legal consultations deeply rewarding. This is because, legally speaking, a conclusion can always be reached, and a guiding light eventually appears. Whether or not that light can actually be reached is another matter—that belongs to the stage following the consultation.

Without going into too much detail about my specific role, I believe I have significantly more opportunities than other lawyers to provide consultations for clients without referrals who have international roots.

A lawyer’s primary field is the courtroom, and our main job is to fight in litigation. Yet, through this work, I frequently encounter moments that convince me of the power of legal consultations to change a person's life.

January was a month where I spent a lot of time thinking about how to improve "access to legal expert." From next month onward, I want to put the plans I’ve developed into action.


En una consulta legal, no basta con dar simplemente una opinión jurídica. Es natural que los clientes sientan rabia, una ansiedad insoportable o que sus emociones fluctúen, ya que son seres humanos. En esos momentos, los problemas no se pueden resolver aplicando fríamente la ley.

No me limito a lo legal; necesito que me cuenten todo: lo que ha pasado en su entorno, lo que podría pasar, la estructura familiar, la postura y los deseos del cliente, e incluso las peticiones de las otras partes implicadas. A partir de ahí, pensamos juntos cuál es el mejor camino a seguir.

Es una labor bastante exigente, ya que debo analizar la situación y sacar una conclusión en apenas 30 minutos con alguien a quien acabo de conocer. A veces, se siente como avanzar a tientas en la oscuridad.

Sin embargo, encuentro que las consultas legales son muy gratificantes. Esto se debe a que, desde el punto de vista jurídico, siempre se llega a alguna conclusión y se puede ver una luz hacia la cual avanzar. Por supuesto, si esa luz está al alcance de la mano o no, es algo que corresponde a la etapa posterior a la consulta.

Sin entrar en muchos detalles sobre mi ubicación o labor específica, creo que, en comparación con otros abogados, tengo muchas más oportunidades de atender de forma repentina a personas con raíces extranjeras que vienen sin recomendación previa.

El campo natural de un abogado son los tribunales, y nuestro trabajo principal es luchar en los juicios. No obstante, al realizar este trabajo, a menudo me encuentro con situaciones que me convencen de que una consulta legal tiene el poder de cambiar la vida de una persona.

Enero fue un mes en el que reflexioné mucho sobre cómo lograr el "acceso a experto legal". A partir del próximo mes, quiero poner en marcha los planes que he estado diseñando.
