退職勧奨 Mutual Separation Offer

2025年が始まり、東京パブリック法律事務所への移籍から1か月が経ちました。忙しい日々が続いていますが、相変わらず家事事件や労働事件のご相談を多くいただいています。
今回は、その中でも特にご相談の多い 退職勧奨(mutual separation offer) について解説してみようと思います。
One month has passed since the beginning of 2025, and I have been adjusting to my new role at Tokyo Public Law Office. As usual, I continue to handle a significant number of family and labor cases. Today, I would like to focus on a particularly common topic: mutual separation offers (退職勧奨).

1. 退職勧奨とは? / What is a Mutual Separation Offer?

退職勧奨とは、会社が労働者に対して「退職を促す」ことを指します。これは解雇とは異なり、労働者の同意が必要 です。
A mutual separation offer is when a company encourages an employee to resign. It is different from dismissal because the employee must agree to leave.

例えば、

「申し訳ないけど、あなたのパフォーマンスが良くないので退職してほしい。」

このような形で会社から退職を促されることがあります。
For example,
a company might say:

"We’re sorry, but your performance has not been satisfactory, and we’d like you to leave."

労働者は退職勧奨に応じる義務があるのか? / Do Employees Have to Accept a Mutual Separation Offer?

退職勧奨に応じる義務はありません!
The simple answer is NO – you are not obligated to accept a mutual separation offer!
裁判所も、「労働者が退職勧奨に応じる義務はない」と明確に判断しています(鳥取地方裁判所 昭和61年12月4日判決)。
Japanese courts have ruled that employees are not required to accept such offers (Tottori District Court, December 4, 1986).

したがって、会社から「辞めてほしい」と言われても、断ってOKです。
So if your company asks you to resign, you can simply refuse.
しかし、ここで注意が必要なのは、退職勧奨を拒否すると 解雇される可能性 があるということです。
However, refusing a mutual separation offer may lead to the risk of dismissal.

2. 退職勧奨を拒否すると解雇されるのか? / Will Refusing a Mutual Separation Offer Lead to dismissal?

企業が退職勧奨を行う背景には、「その従業員に会社を辞めてほしい」という意図があります。しかし、日本では 解雇のハードルが非常に高い ため、企業は慎重に対応する必要があります。
Companies offer mutual separation mainly because they want an employee to leave. However, dismissal laws in Japan are very strict, so companies must be careful.
裁判所が解雇を「違法」と判断した場合、企業にとって大きなリスクとなるため、簡単には解雇できません。
If a court rules that a dismissal is unlawful, it can cause serious problems for the company. Therefore, employers hesitate to dismiss employees outright.
そのため、多くの企業は退職勧奨を行い、労働者に「自発的に辞めてもらう」ことを望みます。この際、金銭的なインセンティブ(severance package) を提示することがあります。
Instead, many companies offer financial incentives (severance packages) to encourage employees to leave voluntarily.

Severance Package の相場 / What is the Typical Severance Package?

パッケージの金額は企業や従業員の状況によりますが、一般的には3か月分から1年分の給与 が相場です。
The severance package amount varies, but in general, it ranges from three months to one year of salary.

3. 退職勧奨でやってはいけないこと / What Not to Do When Facing a Mutual Separation Offer

退職勧奨を受けた際に、以下の点には特に注意してください。
When facing a mutual separation offer, be careful about the following:

  • 会社が用意した退職届や合意書にサインしない。

Do not sign the resignation letter or agreement prepared by the company.

  • 転職活動の進捗を会社の人や同僚に話さない。お金をあげなくても退職してくれると思われます。

Do not discuss your job search progress with company staff or colleagues. Company would think you do not want money.

  • 自分から金額を提示しない。お金をあげれば退職してくれると思われます。

Do not state your desired severance amount first. Company would think you can easily leave with chip.

4. 専門家への相談 / Consulting a Professional

他にも気をつけていただくべきことはたくさんありますが、ケースバイケースなので、一概に申し上げることはできません。
退職勧奨の交渉は自分で行うことも可能ですが、専門家に相談することでより安全に、かつ有利に進めることができます。
There are many other important considerations, but they depend on each case and cannot be generalized.
While you can negotiate on your own, consulting a specialist ensures a smoother and more beneficial outcome.
